The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice
and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website
and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers
to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client
or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake
the process of our assistance to the Client in the most appropriate manner, whether by formal meetings
of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect
of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law
of Portugal. Any use of the above terminology or other words in the singular, plural,
capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Company policies
Accommodation policies
-Check-In is after 15:00 and Check-Out is until 12:00 (if you stay after 12:00 you will be charged an extra day).
-Beside the hours mentioned above, Check-In is possible at any time if the client provides the date and hour of the arrival.
-It will be asked a 10 EUR deposit for key, which will be returned to you in the end of your stay.
Surf Lessons policies
– For Students who only book surf lessons, we inform you that despite choosing the time for the activity, the time must always be confirmed in advance according to the tides and sea conditions
– Respect the schedules of the classes. The surf school does not provide any exceptions to the regular surf class schedule.
– If you book more than one day of surf classes you are expected to have classes the next day on each day from the initial start date. After starting classes if you decide not to have a class the next day, you must inform us by WhatsApp to the number of the surf school +351926189894, 24 hours in advance.
– If you are expected for surf classes and you do not show up, the surf school will make no refund.
– The surf lessons are personal and cannot be transmitted to other persons;
– Students are strictly required to follow the instructions of their teacher. Always keep the safety rules. In the case of injury inform your teacher without any delay.
– If Students negligently or deliberately lose, steal or cause damage or irreparable damage to the equipment provided by us during lessons they shall replace/repair the lost or damaged board or wetsuit with another of the same value.
– Group classes will have a minimum of 2 people or more students.
– All Surf lessons cancelled due to no surf conditions will be postponed to a later date.
– Photographs are always taken except for the existence of technical failure of the equipment or adverse weather conditions.
– During lessons, instructors may collect audio-visual content for the sole purpose of promoting our company on all its websites and sales channels or through our partners’ own means of communication. Students (or their legal guardians) consent to this right of the company when booking and paying for the lessons.
– Photo analysis will occur on the hour after the surf session if there’s at least 5 persons assisting.
Surf Rentals
CONDITIONS AND TERMS OF HIRING EQUIPMENT

The purpose of this disclaimer is hiring the sports equipment by request of the leaseholder and which will be provided by the owner – Calhau Surf School (“Company”).
1. The school:
The school declares hiring the sports equipment, by the request or solicitation of the leaseholder accordance with stocks or existence of the Company, with the purposes for which it is intended and special conditions of the relevant hiring.
All items will be delivered by the leaseholder in good conditions.
The delivery of the sports equipment will be made by signing the present agreement and payment of the price for the hiring and a deposit.
Depending on the board, a deposit between (50€ to 150€ in cash) is required.
The owner is not liable for any direct, indirect, or lost profits derived from the execution of this agreement, or use of equipment by the leaseholder.
2. Leaseholder:
The leaseholder of the sports equipment is major or if it is minoris obliged to be accompanied by a written declaration of its legal representative authorizing the hiring of the sports equipment according and with the exact terms of liability set out in this disclaimer.
The leaseholder is required to verify that all sports equipment is working according with correct conditions on delivery by the owner upon its return.
During the time period of hiring of the sports equipment and until the sports equipment are redelivery to the owner, the leaseholder is exclusively responsible for its use as well as exclusively responsible for all damages that it may suffer or may cause, both in person and in the sports equipment, whether in his person or in third person.
If the equipment is accidentally damaged during a rental, the security deposit made by the customer shall be partially charged. However, if the equipment is lost or irreparably damaged during a rental,
the customer shall replace the lost or damaged board or wetsuit with another of the same value.
The redelivery of the sports equipment will be performed personally or through a representative of the leaseholder for the specific purpose.
The leaseholder is obliged to give to the sport equipment a prudent use, according to their technical characteristics, according with operating instructions and making the maintenance and upkeep recommended by the owner or the manufacturer.
It is not allowed to sub – lease the sport equipment or its sale. Any free transmission of the sport equipment by the leaseholder to a third party, shall be is exclusively responsible of the lease holder.
Whatever is not expressly agreed herein shall be governed by the laws in force and the uses and customs under the hiring the sports equipment agreement, and any dispute between the parties will be resolved in the courts of the Company headquarter.
Tip´s
– Be on time for the surf classes;
– The surf equipment is only included for the surf classes. You must rent it if you want to use it after the classes;
– Take a towel and bathing suit to the beach to wear under the suit and also take sunscreen.
– You are responsible for your surf equipment. It should always be cleaned;
– Wash your surf board and wetsuit in the showers at the beach;
– Do not enter the hotel or guesthouse with your wetsuit on
Cancellation policies
After the booking of the surf packs, we will accept the cancellation under the following terms:
a) Up to two weeks prior to arrival we will refund the booking
b) Up to one week prior to arrival we will not make any refund. The client will have a credit at Madeira Calhau Surf School to use for one year.
c) Upon arrival and during your stay we will not make any refund except in the case of serious illness or injury, duly proven by medical certificate.
d) Any transfer fees or bank commissions charged by banks shall be borne by the customer. Madeira Calhau Surf School will not cover these fees and commissions in case of cancellation of the booking.
